Richard D. Anderson

Shareholder; Financial Institutions and Real Estate

Rich is a shareholder in the firm of Briggs and Morgan, Professional Association. He is based in our Minneapolis office and is a member of the Financial Institutions and Real Estate Section and the Bankruptcy Practice Group. Rich practices principally in the areas of:

  • Banking law
  • Bankruptcy law
  • Litigation and commercial lending

Rich has appeared in many of the major Chapter 11 bankruptcy cases commenced in Minnesota over the last 15 years. He successfully represented the lender in a case that established the basic law governing the relationship between the Bankruptcy Code and Minnesota's foreclosure statute.  Johnson v. First National Bank, 719 F.2d 270 (8th Cir. 1983), cert. denied, 465 U.S. 1012 (1984). More recently, Rich represented a major advertising agency in a successful Chapter 11 reorganization. He has also represented Minnesota clients in bankruptcy cases in Delaware, Massachusetts, New York, Illinois, Texas, Arizona and other jurisdictions.

Rich's bankruptcy practice includes an emphasis on assisting lenders, vendors and both landlords and tenants in Chapter 11 reorganization cases. He has also represented clients in connection with the acquisition of assets in bankruptcy and in the defense of preference and fraudulent conveyance actions. He has been an adjunct professor at William Mitchell College of Law since 1987, where he frequently teaches the school's bankruptcy class.

The bulk of Rich's practice, however, involves the representation of clients in non-bankruptcy workout, banking and corporate financing and lending matters. Rich has frequently represented Minnesota lenders in the negotiation and documentation of revolving credit, real estate and term loan facilities. Rich is also a member of the Health Care Practice Group and has represented clients in bankruptcy cases involving the health care industry.

He is a member of the Minnesota State and American Bar associations and the American Bankruptcy Institute. He is active in the Turnaround Management Association. Rich is admitted to practice before Minnesota state and federal courts, and the 8th Circuit Court of Appeals.

Born in St. Paul, Minnesota, Rich received his B.A. summa cum laude from Macalester College, where he was elected to Phi Beta Kappa. He received his law degree magna cum laude from the University of Minnesota Law School, where he was elected to Order of the Coif and served as an editor of the Minnesota Law Review. Rich joined Briggs in 1979.
