Briggs and Morgan's Construction Law Group represents clients engaged in all aspects of the construction industry and in all kinds of construction projects, locally and nationally. Our attorneys handle diverse construction related matters ranging from large and complex industrial and commercial projects to small and medium-sized public and private works of all types and descriptions.

Unlike boutique construction law firms, Briggs is a full-service law firm with attorneys in nearly all areas of practice. If a construction problem involves a related commercial, tax or financing issue, the client will be referred to another Briggs attorney who is likely to be more familiar with the specific issue. We have scores of attorneys who practice in commercial law, labor law, creditor-debtor rights, securities, real estate law, banking law, bonds and public finance, tax, probate, and administrative law.

Our most satisfied clients are those who have avoided a lengthy trial or arbitration as a result of our work with the client in avoiding the weaknesses that breed litigation. We assist our clients in identifying problems with job administration, record maintenance, and claims tracking, and provide the client with suggested procedures and remedies for specific problems. We also assist clients with monitoring of claims as soon as they arise in an effort to resolve the claims before a job may even be completed.

Briggs' attorneys review and revise contracts and purchase orders to ensure that the terms comport with the latest changes in the law, and we will represent the client in contract negotiations if necessary.

We are thoroughly familiar with the most current methods and theories used to formulate a claim that may arise in connection with the design or construction of a project. Our attorneys learn not only through practical experience, but through attending or teaching at local and national seminars and law schools concerning various aspects of construction law and litigation.

In addition, Briggs maintains a comprehensive construction law library containing the latest periodicals and treatises, and our attorneys also have direct access to online legal research sites for quick analysis of a problem. At the first sign of difficulty in a project, we immediately begin working to surround the problem, doing everything as if we were preparing to litigate or arbitrate the claim. Our experience has shown that this approach encourages settlement and saves a great deal of time and money should the matter not settle.

We prepare many construction claims in-house. Briggs maintains a full complement of computers and the latest software and hardware necessary to analyze data and assemble the data into formal claims. We have written several custom databases to handle vast amounts of documents efficiently, and we produce custom graphics and computer modeling to enhance the presentation of claims.

Briggs also has an excellent staff of paralegals who often assist in reviewing documents, coordinating the assembly of data and preparation of the claim. Although Briggs prepares many construction claims in-house, we have worked with renowned experts in many fields. Most importantly, our attorneys know how and when to use outside experts to the greatest advantage, ensuring the most efficient use of an expensive resource.

When a complicated claim arises, Briggs assists the client in deciding which option is the best by applying a sophisticated decision analysis to claims. The analysis, performed with the aid of computers, evaluates the chances of succeeding on issues, litigation costs, and the present value of the claim as well as various options open to the client.

  • Represented general contractor defending against claim of improper backcharges.
  • Represented homeowners in construction defect action against contractor in arbitration and obtained judgment for all damages sought.
  • Represented owner in construction defect litigation involving the construction of new corporate headquarters; Obtained injunctive relief against contractor's effort to arbitrate claims and settled case favorably.
  • Represented subcontractor seeking payment in Miller Act Action.
  • Represented utility contractor regarding OSHA citations; matter settled favorably for client with ALJ mediator.
  • Representing general contractor in dispute with subcontractor regarding subcontractor's breach of contract, fraud and failure to comply with Minnesota Department of Labor and Industry prevailing wage requirements.
