Briggs Client Wins Summary Judgment in Matter of First Impression in Asbestos LitigationPrint PDFShare
In a recent matter of first impression in Iowa asbestos litigation, Briggs helped a client secure summary judgment in Iowa District Court. Briggs shareholder Anissa Mediger, who led the team, argued that pursuant to Iowa Statute 686B.7(5) a product manufacturer was not liable for the alleged asbestos-containing parts purchased from another company and incorporated therein. The Court agreed, finding that under the language of the statute, a “component part” was a “constituent part serving to form or compose or make up a unit or whole.” Because the client did not manufacture the alleged asbestos-containing “component part” of the final product, but instead purchased it from a third party, the Court granted the Motion and dismissed all claims.
