Max Heerman Authors Article for Law360


MINNEAPOLIS, MINN. – Employment and Product Liability Law360 recently featured an article by Briggs and Morgan shareholder Max Heerman.

In Court-Sanctioned Notice in Collective Actions, Heerman discusses the current impact of the 1989 decision in Hoffmann-LaRoche, Inc. v. Sperling. He reviews how the Supreme Court’s decision in that case – when some individuals sue their employer in a “collective action,” notice of the lawsuit should be sent to other individuals who have not sued, but who may be eligible to join the lawsuit – was a catalyst for the increase in collective action litigation, as well as for current feelings of uncertainty about how that litigation should be conducted.

Heerman is a member of the Business Litigation Section and Appellate Practice Group, and practices principally in the areas of: complex business disputes; employment litigation, including FLSA and discrimination disputes; fraudulent transfer, debtor-creditor disputes and bankruptcy-related litigation; shareholder disputes; and product liability. His clients span industries which include transportation, food and beverage and financial institutions. Heerman also volunteers for the Hennepin County Bar Association, serving as a public speaker on various introductory legal topics, leading discussions on the court system, careers in law, and the Constitution.
