Represented County in complex property tax litigation involving large former industrial facility.

Property owner challenged tax assessment of large former industrial facility in residential urban neighborhood, arguing that the value was zero because of the cost to remediate potential environmental contamination and cost to develop property. We obtained partial summary judgment that cost of remediating potential environmental contamination is barred from consideration by Minnesota's "contamination tax" statutes, an issue of first impression. Case was tried in December 2013; decision is pending.
