Representing Defendant. Plaintiff was the former President and CEO of a large financial institution. His employment was terminated after some financial improprieties were called to the attention of the Board. Plaintiff claimed that he was terminated in anticipation of the sale of the Company and therefore was entitled to compensation under his Employment Contract. The jury found that Plaintiff breached his fiduciary duty and engaged in financial improprieties, but nevertheless awarded him amounts due under his contract.
