Dismissal of EEOC charge filed in Georgia against national private transportation carrier alleging race discrimination brought by former driver.

A former truck driver who was terminated for poor performance alleged that his discharged was based on his race. After investigating the matter on behalf of the company, a responsive position statement was filed denying liability and noting that the driver was actually employed as an independent contractor. The EEOC subsequently dismissed the charge.
