Dave is a trial attorney with more than 20 years of experience and a winning track record in complex litigation. His clients include banks, financial institutions, hotels, health insurers, insurance companies, dealerships, product manufacturers, construction companies, advertising agencies, software developers, transportation related businesses, retail, medical device manufacturers, as well as closely held and family owned businesses.

  • Trial experience with cases to jury verdict in employment, non-compete/trade secret, professional liability claims, product liability, intellectual property, shareholder disputes, fraud, fiduciary duty, breach of contract, tortuous interference, transportation and property damage claims
  • Designated panel counsel for numerous insurance companies for professional liability claims
  • Represented EPL, D&O, E&O, CGL and specialty line policy holders in defending business claims to resolution through settlement, summary judgment, jury verdict and arbitration
  • Serves as litigation counsel for a Fortune 500 mining company in the defense of large block of mass tort lawsuits
  • Regularly serves as litigation counsel for Fortune 500 businesses located outside of Minnesota seeking experienced Minnesota trial attorney to handle Minnesota litigation
  • Successfully obtained summary judgment or defense verdicts in discrimination, harassment, reasonable accommodation, retaliation, harassment, wrongful termination, wage and hour, and WARN classaction lawsuits
  • Successfully obtained numerous preliminary injunctions and verdicts for clients in non-compete, trade secret, and duty of loyalty cases
  • Successfully obtained a favorable verdict in a shareholder deadlock dispute resulting in a forced sale of shares and award of attorney fees
  • Successfully defended claims of fraud and theft of intellectual property for a major advertising agency resulting in a jury verdict of no liability and no damages and a sanction award
  • Successfully obtained jury verdict following three-week trial in favor of minority shareholder including an award of attorney fees and sanctions
  • Successfully defended five officers and directors against breach of fiduciary duty and fraud claims resulting in a defense verdict following a 10-day trial and an award of attorney fees

Dave is also a fellow of the American Bar Association, an honor limited to one third of one percent of U.S. lawyers. He is AV rated by Martindale Hubbel, the highest rating for skill and ethics by the leading lawyer survey organization, and has been named a Super Lawyer by Minnesota Super Lawyers 2008-13. Dave is regularly asked to speak to legal and trade groups on employment and business litigation issues. He also serves in leadership roles for legal, nonprofit and community organizations.

Dave received his B.A. from St. Olaf College and his J.D. cum laude from William Mitchell College of Law. Following law school, he served as a law clerk for Magistrate Bernard Becker of the U.S. District Court for the District of Minnesota.
