Marcus is a member of the Financial Institutions and Real Estate section. He practices primarily in the areas of:
- Mezzanine finance
- Structured finance
- Commercial lending
- Asset-based lending
- Unsecured lending
- Banking and finance
- Private equity financing
Marcus negotiates and documents a variety of finance transactions on behalf of mezzanine debt investors, banks and other financial institutions. He concentrates a significant amount of his practice on the representation of mezzanine and junior capital funds in subordinated debt and equity investment transactions. He represents banks and other financial institutions in connection with senior and subordinate credit facilities and asset-based loans. He also represents borrowers in connection with working capital and other secured and unsecured financing arrangements.
Marcus recently worked for a large financial institution, where he managed investments on behalf of trusts, foundations and individuals. Marcus has passed levels I and II of the CFA exam, as well as the Series 7 and 66 exams (licenses inactive). Marcus’ clients benefit from his practical application of the knowledge and perspective gained from these experiences.
Marcus is licensed to practice in Minnesota state and federal courts. He earned his B.S. in accounting, magna cum laude, from the University of Denver, where he was on the Dean's List and earned multiple awards for excellence at the Daniels College of Business. He earned his J.D., summa cum laude, from William Mitchell College of Law, where he was on the Dean's List and was a staff member of the William Mitchell Law Review. Marcus' writing also has been published in William Mitchell's legal research text, The Process of Legal Research.
Marcus' experience includes:
- Financing of equity and asset acquisitions on behalf of subordinated debt an equity investors
- Restructuring of $125 million credit facilities to ethanol plant on behalf of agent for participated loans
- Refinancing of $128 million term and revolving credit facilities on behalf of a sports franchise as borrower
- Floor plan financing of bus dealership on behalf of bank
- Sale of lumber company in Chapter 11 bankruptcy and related financing on behalf of existing secured lender
